Pupil Attendance Regulation Waiver Request (SY 2022-2023)
**The submission process for the 2022-2023 school year is open.**
The Kentucky Board of Education authorized the following waiver at the April 20, 2022 meeting to provide districts flexibility to meet the unique learning needs of their students, families and communities. This opportunity will allow districts to design and offer attendance-based virtual learning opportunities for the appropriately identified students in grades Kindergarten through Fourth (K-4) where current virtual/performance-based options do not exist. Districts may apply this attendance-based structure to grades beyond fourth as well provided the waiver assurances are followed for all grade levels included. As a reminder, districts will continue to have the traditional “performance-based” virtual option for grades 5-12 through 704 KAR 3:305 (7) which provides more design flexibility to meet enrollment, staffing and other needs of a district's school, program, or academy.
Quick tips and reminders for submitting your waiver:
1) A brief narrative is required. While the waiver assurances stand on their own, the narrative describes the district's plan to implement the waiver.
2) A PDF containing the appropriate signatures and dates will be uploaded on the final question of the form.
3) Similar to last year, there is no deadline for submitting a waiver request to allow districts the option should circumstances change.
