The Kentucky Department of Education (KDE) funds the state paid benefits for the Local School District Employees for Health Insurance, Life Insurance, Administrative Fees, Health Reimbursement Accounts (HRA) and the Administrative Fee for the Flexible Spending Accounts (FSA). KDE pays the state premiums for these benefits to the Department of Employee Insurance (DEI) on a monthly basis on behalf of the Local School District Employees. KDE pays an administrative fee to DEI for the Health Benefits and the FSA for DEI to administer these benefits.

Affordable Care Act
The Affordable Care Act (ACA) was signed into law on March 23, 2010 and consists of sweeping changes to the US health care system. The major component for mandated health care became effective January 1, 2015. This “play or pay” mandate required large employers to offer full time employees the opportunity to enroll in employer-sponsored health plans or risk paying substantial penalties.
The policies, regulations, procedures, and examples in the KDE Implementation Guide, are subject to change as deemed necessary by law under the Department of Treasury Affordable Care Act provisions. This document is provided for educational and informational purposes only, and should not be relied upon for legal advice. The Guide contains many useful legal and state mandated websites to assist districts in understanding the requirements of the Affordable Care Act.
An informative webinar, entitled "How to Avoid an ACA Reporting Penalty" was presented by American Fidelity Administrative Services on February 7, 2019. This webinar outlined the parameters of proper ACA reporting, and detailed corrective procedures to follow in order to avoid an IRS penalty.
