Site Acquisition
Local boards of education may purchase real property with approval by the Department. Approval is a two-step process which is initiated by a written request by the board to the Department for an inspection of the site. Upon inspection, the site is either disapproved or tentatively approved. Tentative approval allows the local board to gather additional information related to the site. Review of this information results in disapproval or final approval to purchase the property.
Surplus Property
School property which a local board of education proposes for disposal shall be surplus to the needs of the educational program of the district as determined by the effective facility plan. A request to dispose of the property shall be submitted to the Department for review and approval.
Property Leases
Proposed lease agreements involving a local board of education shall be submitted to the Department for review and approval. A lease shall not affect the integrity or usefulness of property crucial to the educational needs of the district.
Easements
Proposed easement agreements involving a local board of education shall be submitted to the Department for review and approval. An easement shall not affect the integrity or usefulness of property crucial to the educational needs of the district.
Joint Recreational Facilities
A local board of education is allowed to cooperatively develop and maintain recreational facilities on school property. Proposed agreements shall be submitted to the Department for review and approval.
